    Had this from Lowell Solicitors today:



    Despite assurances they I didn't need to do anything, I contacted them as I'm currently settling a claim via a Mediation Agreement and making payments to a Bank Account in the name of "Bryan Carter".

    Quite an interesting conversation - firstly the Chap at LS firstly mentioned that "a few files hadn't come over", in such a rehearsed way that made me think he was understating it, later when we were chatting (it might be worth saying at this point that I worked for many years in an investigation role with one of the banks and have a knack for making people relax into saying a bit more than they should do really) that they had very little from BC, and as they'd ceased trading they couldn't go back to ask them for any more information.

    I haven't really worked out what impact it has for me - but, he confirmed that the only info they had for me was my KYC stuff (DOB, Address etc) an outstanding balance and history of payments - and ask if I'd be so kind as to e-mail them a copy of my Mitigation Agreement for their files!

    So there we have it, I'm paying a defunct solicitor for an outstanding debt to a defunct finance company, via a CC Claim brought 3 months before the it was statute barred, and I still don't think I can weasel out of it ha ha .

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
