    Hi.
    Im new to this so please bare with me. I have today received a county court claim on behalf of Lowell Solicitor acting on behalf of Lowell Portfolio
    This is for £5801.40
    The orginal debt is Lloyds Banking for £4985.44
    On 18/12/2015 i received a Letter of Claim from Lowell Solicitors. I wrote back on the 29/12/2015 asking for copies of all agreements, default notices etc. And any other debt. they have
    I received an acknowledgement letter dated 18/01/2016 saying they would request the info from their client and forward them to me.
    I hadnt heard anything else until today which is the county court business centre.
    I am unsure what i should do, as i have not received the info i requested and they have to provide by law.

    Good afternoon, welcome to LB,

    1. Have you acknowledged service of the claim.

    2. Did you make a formal request for a copy of the agreement (CCA request ) together with the £1 statutory fee to the claimant and/or a CPR31.14 request to the solicitors for the documents mentioned in the particulars of claim.

    3.Which Lowell company is the claimat.

    4. What type of account is this, who was the original creditor?

    5. How much is claimed.

      Hi.
      I have only just had it today so have done nothing with it.

      Yes i sent a formal request (cca) & £1 PO TO Lowell Financial (clamiant)
      And a formal letter to Lowell Solicitors stating the practice direction pre-action conduct
      Orginal creditor is lloyds banking
      The claims for £5801.40 Including court fees

        Ok. Acknowledge service online at MCO ( instructions on the claim) state intention to defend in full But don't make any statement in defence at this stage.

        When did you send Lowell the CCA request they have 12 + 2 working days to comply with the requaest

        Disregard any statements from Lowell saying the claim is on hold unless they state they agree to an extension of time ( 14 days or 28days max) their " On hold does not stop the court process.

        Is this a bank account/overdraft/ loan/ credit card?

        When was the account opened?

        Do you know the default date?

          I requested the info on the 29th dec 2015.
          This is a loan
          Im not sure of the dates etc.
          I havent had anything from lowells saying its on hold etc.

          Im not saying i dont owe it, its just that i havent had info and they have sent it to court.

            Ok there's been a certain amount of chaos caused by Lowell dropping a firm of solicitor for its new in house bunch Lowell Solicitors Ltd

            I suggest that you send both requests again the PO for the £1 statutory fee must be marked " For Statutory Fee Only " on both sides make a copy and keep it for your records.
            Send it by signed for post and check and print off delivery date and signature. ( there's a lot of nonsense going on with these requests)
            CPR 31.14 again to the sols.

            I suggest you check your credit reference files to see what dates are on there you can check Noddle Free Online.

              On the actknowledgement of service, which box do i tick
              I intend to defend all claim
              I intend to defend part
              I intend to contest jurisdiction
              ??

              And after ive done all that. What do i do?

                Defend all don't state anything in defence at this stage.
                Submit on MCOL.

                Then redo the request there are templates in the " green short cuts box above".

                Do not dispute jurisdiction unless you live in Scotland od NI
