Counterclaim Against RBS
Can someone talk to me please?, I need help and advice, I have received a claim form from County Court Business Centre, Northampton. A Debt Collection Agency in the name of Cabot Finanancial { Marlin Ltd }, have submitted a claim on behalf of RBS to recover a credit card debt. I totally admit the debt the debt but this is nothing compared to the what they owe me!

I am disputing a claim and making a counterclaim against RBS, I received a claim form the CCBC in Northampton, the company making the claim Cabot Financial { Marlin Ltd } are acting on behalf of RBS to recover a twelve or could be older credit card debt. I had totally forgotten about and I am angry that they are stilll pursuing this, the reason being is this debt amounts to about just over a thousand pounds, I don't know why I didn't pay this debt off when I had the chance years ago, I just didn't. My point being this is nothing compared to what they charged me over a five year period, this amounts to approximately in excess of £8,000.

Is this the same case, you've received a claim from Cabot/Marlin for a credit card debt you held with RBS.
Are the charges you are talking about credit card late payment charges on the same account ? What period were those charges over and how much a time ?
Do you have statements available and had you previously made complaints about the charges ?
You will need to acknwoledge the claim and send a CPR and CCA request off as per First Steps post as Charitynjw posted ( see http://legalbeagles.info/forums/show...it-Court-Claim ) so get those done first then we can have look at the account and see if you can do anything regards the charges.

Hi Kati, I am making a counterclaim against RBS for a past claim for unfair bank charges, I received a claim form from CCBC Northampton, a debt collection agency under the name of Cabot Financial who are acting on the behalf of RBS have sought to recover a credi card debt with RBS.
I felt that I should challenge this because this is nothing compared to what I went through at the time and what they charged me over a five year period which amounts to £8,000. My income was eaten by charges upon charges, I had to sell my home because I was threatened with repossesion.

If we are going to help you we will need all the details please.
How much is being claimed?
Cabot Financial (Marlin) is a debt purchaser not a debt collection agency it would now own your debt and will have no knowledge of any dispute with RBS.
When was this account opened?
When was it defaulted and the close?
Please explain in detail if possible why and how you believe RBS owes you money and how much you believe is owed.
Cabot (Marlin ) is a debt purchaser not a DCA it will have bought your debt from RBS.
