  • Lowells court claim form.

    Hello all,

    I've searched to see if there is any other thread like my situation- but I can't see one.

    Lowells have brought my debt from lloyds bank. I had the usual haressment letters, I was then out of the country. I returned in Feb this year, and tried, multiple times to contact them to set a payment plan.

    After I could not get hold of them, I followed advice on their paperwork and set up a standing order for the princely sum of £10 per month.

    This was taken on the 26th of Feb.

    I then receive a court claim order dated 3rd March - demanding I pay the full amount in 2 weeks, or get a ccj.

    Baffled, I ring them and finally get hold of one of their drones, who inform me even though I set up the standing order and they have indeed receive payment- it doesn't count as I didn't speak to them and long story short 'computer says no'. And the court claim still stands.

    I was also advised that even if I set up a payment plan now, I would still get a ccj - which as I pointed out to the cretin on the phone - why on earth would I do this?! I would rather take the ccj and not pay - the amount I owe is so small I would never receive bailiffs as it would not cover the cost. And frankly after they have messed me about after I tried to do the right thing I would rather take the hit on my credit than have them get their disgusting greasy mitts on my money.

    So my question is has anyone else been in this situation? Any advice? I of course have all the proof in phone records of the times they ignored me.

    What was the alleged debt for? (CC/OD/loan etc)

    As you have now received a court claim, have you had a look at the suggested course of action in the green bits at the top of this thread?

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
