Re: Claim form received from county court

    Thanks nem.

Could you give me advice on filling in the N180.

A1: Should i agree to mediation?

C1: do you agree that the small claims track is the appropriate track for this case yes or no

D1: hearing venue, do I put my local county court?

Shall I then copy and send to court, claimant and their solicitors?

Thanks so much for your help in this matter.

Yes (it looks good if you agree)

      Yes

A copy to the claimants solicitors (the correspondence address on the claim form), a copy for the court, a copy for your records

Thanks so much for your help in this matter.

              [QUOTE=Helpneeded2016;648198]Thanks nem.

Could you give me advice on filling in the N180.

A1: Should i agree to mediatioYes it is expected that the parties to a claim will attempt to resolve a claim without recourse to a hearing.

C1: do you agree that the small claims track is the appropriate track for this case yes or no Yes

D1: hearing venue, do I put my local county court? Yes

Shall I then copy and send to court, claimant and their solicitors? , Yes

You will receive a phone call from HMCTS Small Claims Mediation Service. A mediator will ask you to answer some question The mediator will most likely decline to continue to mediation.
The claim will then be sent to your local county court hearing centre for judges directions.

Hi, what should I put in the covering letter with the N180 form to the claimant 'Hosit'and solicitors 'Howard Cohen' or just send the form? Also should this be recorded delivery for proof of sending and receiving. Thanks

Sorry one more question. When I copy the N180 form for the claimant and solicitors should I block out my signature just in case or doesn't it matter? Thanks nem

Why would you block out a signature on legal documents?

On previous some advise I read there was something about not signing documents or letters so the claimant couldn't use your signature. Sorry its me panicking I guess, thinking it's all documents!

Not any documents HN, the " signature lifting " twaddle has been around for years I've not seen any proven evidence that it has ever been done.

Re: Claim form received from county court

Update on the mediation phone call which happened today. when the phone call commenced I confirm that i haven't received any of the paperwork requested from the claimant or the solicitors. the mediator informed them of this and replied with they were very disappointed we did not want to mediate with them. They also said it takes time to get paperwork, I requested this on 7/3/16. Do they expect you to accept everything and cave in?

The mediator been confirmed I would be getting a court date. Feeling very anxious as I do not know whether the solicitors Howard Cohen and Co will turn up at court. Has anyone dealt with them recently did they turn up what was the outcome of the court hearing, thanks

Hi as this stands now the debt remains unenforceable until the agreement or a compliant reconstituted one is provided.

Re: Claim form received from county court

Hi everyone update on the case. I received a court case date for the 20th of October 2016. I was fully prepared to go to court to defend stating no information received, however I have received a letter today; a general form of judgement or order to say the claimant failed to pay their small claims hearing fee of £335 therefore the judge has ruled the claim be struck out and the small claims hearing listed be vacated.

What does this mean? Is it finished and hoist cannot claim for this debt again. Is there any way I can make sure this debt cannot be pursued by any debt company if it's sold on and they try the court route again.

                                Any advice appreciated.
