    Obviously then the extension was purely for their own benefit not yours if they don't respond to the defence then yes the claim will be stayed but please note you will not be informed if this happens it is essential to check with the court for the status of the claim.

      Ok. Planning to check the status of it this week as it has been a month since the defence was due.

      When shall I expect it to get stayed? 28 days from the date of me submitting my defence or 28 days from the defence submission deadline? Or is it 28 days from when Mortimer Clarke received my defence? (They acknowledged receipt in the letter they sent on 21/03/16).

        Checked with NCCBC. The claim was stayed on 11th April. Hoping to receive a notice of discontinuance in the near future.

          Imho, unlikely.
          Without further action from you, it will probably just remain stayed.

            Sound good Shazza, perhaps if they don't discontinue a letter to the solicitors " inviting " them to advise their client to discontinue should /could be sent.
