    Yes most definitely.
Especially if they intend to rely on the same alleged agreement as before.

definitely acknowledge the claim (same process as before). CCA and CPR ... I would send them just to be awkward (make them work for a bit before it gets thrown out ) xx

          Re: Proof of identity

          Good morning ladies,
I went though my previous claim paperwork and found the General Directions Order that I have received from the court but forgot about it.
I've acknowledge the claim with intend to defend in full. I will send them the Cca and Cpr 31.14 today in the post .
Can someone give me an idea of I should write in the letter I intend to send to them ?I will enclose a copy of the order but I'm stuck to what I should write.

I have all the paperwork/correspondence from the previous claim Kati.
          Thank you!

                      Ok Icrina,

                      To Mr Baskind
                      Director Cohen Cramer Solicitors.

                      Date:

Ref: CC Claim No.xxxxxxxxxxxxxxxxxxx issued on:.......................................

                      Dear Mr Baskind,

I refer to the above mentioned claim received on date, acknowledgment service and intention to defend has been filed with the court.

As you are no doubt aware a previous claim No................................... regarding this matter was struck out by District Judge .......................... on see " general form or order or judgment attached.

As the strike out application was uncontested I fail to see why Cohen Cramer has commenced a new claim.

Please consider this letter a further formal request under the provisions sect 77/78 of CCA 1974 for a copy of the regulated agreement ( statutory fee enclosed) relative to this claim, you are reminded that documents already provided did not satisfy such request, therefore unless Cohen Cramer can show that any documents it's client now intends to rely upon have merit in regard to this " new " claim I will ask the court to strike out this claim.

I am also making a formal request under the provisions of CPR 31.14 for copies of all documents mentioned in the particulars of the claim and expect them to be provided within 7 days of the date hereon.

                      Yours etc.

                      Signed for post as always.

I wonder if the previous letter was even read, what date did they receive it and what date was the new claim issued?

Looks like it was ignored, which may be useful later.

I received the response for my CPR request saying that all the documents were sent to me in April , the ones I posted already .

                                Hi Nem,

I sent the letter you helped me with ,and received nothing back. For my CPR request they just responded saying they sent me all the paperwork back in April.
I need to file my defence by the 13th , will you please help me out with what I should write in there?
Do I need to submit an "unless order " with the defence as well?
Do I need to base my defence on the fact that the previous claim was struck out?

                                Thank you !
