          MFC is a division of Cabot Financial Was Marlin) Apex is also a Cabot company.

          What type of account is this, current account/overdraft/ unsecured loan/HP/credit card?
          On to the claim pack.
          Claim Form (N1 ) gives details of how to manage the claim online at Money Claim Online (MCOL)
          Do this now and state intention to defend the claim in full. DO NOT enter anything in defence at this
          stage.

          Follow these stages: We can follow progress easier this way.

          1. A CCA request to MFS with £1 statutory fee ( Postal Order for £1.00 endorsed( " For Statutory Fee Only) (template available in the forum library) The claimant has 12 + 2 Working Days to Comply. Use signed for post and check delivery date:

          2. A request under the provisions of Civil Procedure Rule 31 . 14 (CPR) (no fee) this is a request for the documents mentioned in the Particulars of the claim Only.

          i.e. The Contract and the Notice of Assignment, ( I see no mention of a default notice) this goes to Restons FAO Nigel Petrie Coe by signed for post, 7 days to comply.

          Once you have completed those stages please give me as much history as possible on the debt, e.g. default date / date last payment.

            Thank you for your information. This is a c/card a/c.

            I have defended the claim in full. I have not entered any defence information.
            I also put in my dob, I'm not sure why. I was following the online instruction. Hopefully it won't be detrimental.

            For the next stage i.e. letters, I will look at the Library information.

            Hello,

            At the end of July 2013, I sent a cca request letter to Apex (dca). Within the timeframe I received the response below.
            "We have referred your account to Lloyds Banking Group to enable them to supply the information you have requested. Whilst we are waiting for your account information from our client, we can confirm that we have placed your account on hold and we will contact you once we have received a response from our client."

            I haven't received the full compliance information from my cca request, even though they responded before Friday 16th Aug 2013.

            I have summarised the details of this a/c below:

            Type of a/c: C/card
            C/card company: BOS
            Correspondence: received settlement offers of varied amounts over the years
            Opening credit limit: £3,600
            Date c/card opened: Feb 2001
            Closing credit limit: £8,900
            PPI Included: n/a
            Charges and Late fees incl: yes
            Interest % amounts: 12.94%, 13.9%, 21.95%, 24.4%
            Balance before transfer to dca: £9,600+
            Name of dca: Apex
            Current monthly payments: £5.00 by s/order
            Latest payment made: August 2013
            Statements received from dca: 1 to 2 times per year
            Balance to date: £9,200

                      CPR 31.14 request to the Solicitor

                      Hi all,

                      I have read some info about requesting the CPR from the claimants' solicitor.

                      However in the POC, apart from the info received in the court pack mentioned in post #13, no other documents have been mentioned or received.

                      The POC only states the following:

                      Particulars of Claim:
                      "The Claimant claims payment of the overdue balance due from the Defendant(s) under a contract between the Defendant(s) and BoS dated on or about Jan 31 2001 and assigned to the Claimant on Jun 29 2015"

                      Therefore, what do I write in the CPR letter?

                                Hi Nem,

                                I just wanted to update you that the CCA and CPR requests - both dated Friday 18th were posted on Saturday 19th Dec. Rec/del.

                                For the CPR, does that mean that now I wait until 7 days from then (i.e. Christmas Day) and then chase up if nothing is received?
