Is NOT following the correct court process in ignorance reason enough to apply for a set aside?

The judge will simply state it is the defendants duty to get counsel if he is unsure on procedure

Saying that pay £155.00 as the judge can only say no, you might get him on a good day

Did the claimant respond to the CPR / CCA letters at all ? In their responses did they mention putting it on hold while they got documents ?

Yes your defence will be that it is statute barred and the lack of documentation from the claimant.

lol i can think of a few harsher words,
found a letter from bc,it basically says it will go to small claims therefore cpr does not apply

Now how does he know it will go to small claims, only the judge can make that decision at the directions stage so CPR duties will still apply

That man gives the legal profession a bad name, he either needs to be struck off or put out to graze at his age.

If you have had a CCJ awarded then you need to do an application on an N244 form and submit it to the court. That is going to cost you now i believe £155.00

I believe you can do it on line but you have to submit by close of business this monday at the latest

I am sure there are some links on the forum for dummies to set aside the CCJ.
No offence as i have used it myself, figure of speech

As you know already failure to follow correct court procedure will bite you on the rear

i know im so stupid just thought with calling bc and telling them that the debt was statue barred and then sending them a request for cpr they left it,
the original account was with mbna
roughly around april 2008
and yes sent cpr request to both lowell and bc

Do you intend to apply for set aside?

If so gather your evidence on the status of the debt when the claim was issued, you have
to that debt was already statute barred on the date the court claim was issued.

You need to have all this sorted as you have a limited time to apply.
