Re: County Court Claim from Lowell/Bryan Carter re Lloyds

I think it will fit in the box on MoneyClaim online. Did you check the claim was still open on MCOL already?

I would submit that like yesterday to MCOL as MONDAY just gone was your time limit. Being the weekend and that MCOL run 3 to 4 days behind will probably have saved you

I very much doubt Lowell would have even realised the time is up yet to request a judgement as you claim will be one of hundreds in the system from llowell

Re: County Court Claim from Lowell/Bryan Carter re Lloyds

I keep getting an error saying the claim number or password is incorrect.... I'm starting to get quite concerned as they are still sending all correspondence to my in-laws' address which means everything is being delayed even further despite giving them our correct address...

You can email the defence to MCOL as a last resort

MCOL IS NOT VERY USER FRIENDLY

          Try every hour

OK.... we managed to get in and submit the defence. Hopefully that should do the trick!

Re: County Court Claim from Lowell/Bryan Carter re Lloyds

Super, well done. Fingers crossed for you Next step should be a letter from court saying the defence has been sent to claimant and asking you to complete a directiosn questionnaire (N180). Probably you'll also get a begging letter from BC as well saying they want to pursue do you want to pay up now.

                  Complete the N180 - example http://www.legalbeagles.info/forums/...132#post468132

Have you had anything off the claimant yet?

keep that letter safe if Carter has been advised of the correct address then
there is the possibility of some abuse here.

e-mail Carter a Formal Complaint about this asap state that the deliberate use of a wrong address is being reported to regulators and the court.
Check with the court tomorrow to see if has filed and inform them of Carters action as well.
Seen this done before and Carter claims " a clerical error".

I've just noticed on the cover letter for the N180 it says we must send it to the court & serve copies to all other parties. Does this mean we also have to send it to Lowell & Bryan Carter?

To the Court and Carter as the legal representative of Lowell, and of course a copy for you.

OK, so we sent of the N180 & we received this via email... Unsure what to do though as we are certain the debt is statute barred but Lowell have NOT provided the documents we requested to verify this either way....

So email them saying Lowell haven't provided the docs ... it does say that mediation cannot go ahead if you answer "no" to any of the requirements and you should contact the mediation team to inform them (email preferable)

OK so after a period of hearing nothing at all we have now received this....

Can anyone give us some guidance as this seems to suggest that Lowell are now taking it all the way to court, despite having not provided us with any of the documentation we need to defend the claim
