  • Old CCJ thats now turned into an Attachment of Earnings

    Hi Beagles.

I jointly owned a company back in 2004 that went into financial difficulties in 2006. As a result, we gave the van back to Duncton Finance which was being leased. At this point, I believed that we were acting in good faith by handing them the van back. I never heard anything from them until I found out that there was a CCJ attached to me in 2009. I tried to dispute it but the judge wasn't interested when I stated I had not been informed. Last week I was issued with an attachment of earnings order thru my employer requesting £150 per month for this debt. I have no idea what to do but cant afford the £150 per month. Any help would be greatly appreciated?

    Hi and welcome aboard

Presumably you offered a personal guarantee or you wouldn't have had a CCJ in your name for a company debt. It's a bit late now to dispute a CCJ from 2009. :mmph:

Have you been making payments into this CCJ? Attachment of earnings orders are granted when the judgment debtor isn't making payments or keeping up the agreed repayments. Have you received an N56 form to fill in and return or have they gone straight to your employers?
