    As I wish to get the ball rolling on this one pretty quick, can anyone advise on how I approach BC regarding making a monthly offer payment via Tomlin order, I've no idea what I have to do or how I word any such request, I would like to get this underway as the court case is due in March?

      A simple offer

      Sir/Madam,

      Re: County Court Claim No................................................ .....:

      I am willing to settle this claim without recourse to hearing in the interest of saving cost and court time.

      I have prepared and income and expenditure statement and have concluded that I can reasonably afford
      to make an offer of £xx.xx per month and payments to be secured by a Consent (Tomlin) Order.

      I would remind you that there is no certainty that a court would award more as this offer has been
      calculated on the basis of it being " Reasonable, Affordable and Sustainable.

      I would appreciate a response to this offer within 7 working days of the date hereon.

      If this offer is rejected I will make the court aware of your clients refusal.

      You send 1 copy to Carter, 1 Copy to the claimant addressed for the attention of Andrew Bartle COO the Lowell group.

            Update, I have received a reply from BC excepting the Tomlin order offer of £10 - month, so one final debt to deal with, I have received a letter from moorcroft who have purchased the debt from Arrow Global, they wish to discuss a payment plan re my 2500 debt with them, so how do I approach this one, prove it letter or something else?

                Happy new year to you nem, OK.. I have very little history on this one also, this is similar to the last, can't even remember what the debt is for, I think it was a bank loan, but not 100% sure?
                again..I'm not sure what they have on me at this stage?

                        OK, No claim so far 6 months and a few days possibly to being statute barred if no payments or acknowledgments
                        after the default.

                        Choices.

                        1. CCA request to AG. risky.

                        2. SAR to the original lender to see if there's documents that AG can request ( my favourite in your situation) the credit has to hold data
                        for 6 years after an account is closed.

                            Ok, Have you checked credit file for the account? Noddle is free online, it would be worth checking!

                                Nem...not connected to this account I know but... out of interest why is the BC debt not showing on my credit file, thought that would have been in there?
