    Hi FlamingParrot,

    Just had a response back from Mortimer Clarke , confirming that their client is willing to agree to the extension of 28 days.

    They say "We believe that you may have already "inspected" the documents to which you make reference because on various dates in the past they would have been sent to you by another party such as the original creditor."

    They then ask which documents she has to avoid duplication.

    Also how does my wife notify the court?

      They should still supply the documents they are relying on for their claim regardless what the OC may have supplied.

      The court can be notified by email headed with the claim number & claim details (Cabot v her name). Attach a copy of their letter (scan or photo) if you can.

            What ever Cabot says the documents mentioned in the particular of claim will have to be disclosed at least 14 days prior to the hearing.

              Have you submitted a defence? I can't see any mention of it on this thread, last thing I can see is you were going to inform the court that an extension had been agreed.

              If the claim was issued on the 8th of June, even with the 28 day extension, your defence would have been due 10 days ago on the 8th!

              There was another poster with a claim from Cabot also issued on the same day who somehow also thought they had to wait for Cabot to respond before submitting a defence, they only submitted a 1am last night and it looks like it was accepted. ray:

              Acknowledge Claim - within 14 days from Service

              Defend Claim - within 28 days from Service (IF you acknowledged in time)
