  • Not sure if this is the right place, i am being pursued for a magistrates fine that

    Hi there,
i wonder if you could advise me,
the magistrates enforcement team are chasing me for a tv licence debt which is not mine, in a house i've never lived in, in a town i've never lived in, despite me sending them irrefutable documentary evidence that i was not even in the country at the time, as i was on a 2 year work visa in Canada which started long before and ended way after the court hearings etc.Despite all this they have told me that unless I go to court and swear that i am innocent before the magistrates, (which due to their mistake will incur costs to me such as lost pay etc , which i might ad, they point blank refuse to pay) they will come to my house and with a repossession order to remove goods to clear the debt, and if i refuse or resist that i will be arrested and there is nothing i can do about it.

How can this be when i have already proven it couldn't have been me, they have not one single shred of evidence other than a similar name, it would seem they just chose me at random and pointed a finger at me and said YOU ARE GUILTY full stop.
I am having sleepless nights as it plays on my mind, and i keep getting phone calls accusing me of dodging the fine, etc, they keep saying things like "your debt" and you owe etc etc. now every time a van pulls up outside the house, i have to look to see if its a bailiff, its not a joke its really causing me serious anxiety.

Funny i always thought we were supposed to be innocent until proven guilty, and in this case i have proven my innocence but still they harass me.

    Hi welcome to LB,

In what are was the " offence" committed?
It may be possible to get this moved to your local
magistrates court if the " enforcement team" is from
    a different area.

it is for an unpaid court fine for an unpaid tv licence, they seem to have my name ni number and phone number and date of birth, but they havent said if they added these details or if they were furnished by the true defendant (ie identity theft) they just seem to be pursuing me, as if i am the only person with that name in the world! in fact today i met wioth the enforcement guy who sadi if i didnt sign his recognisence form he would just call the lads...in the van, arrest me and take me to the magistrates, so much for my evidence of not even being here at the time!!

I think you will have to get to the Magistrates Court and take an oath as they suggested.
Apart from that, who exactly is dealing with this a private company or court bailiffs.
