Court order from Cabot help needed.

  • Court order from Cabot help needed.

    Hi guys need ur help again plz. Had a court claim from Cabot regarding premier man. I just send off acknowledgment also a cca request to Cabot.

    The particulars of the claim says

    '' in respect of a credit agreement regulated by the consumer credit act 1974 whereby Premier credit - mail order. Original creditor, provided the defendant with goods. In return the defendant agreed to pay at least the minimum payment given in the statement. A default notice was served in the defendant which has expired and upon which the defendant has failed to comply with. A notice of assignment has been sent to the defendant notifying them that this debt has been assigned to the claimant. The claimant therefore claims the sum of 2,574.08 plus costs. The claimant has complied with sections III and IV of the practice direction on pre action conduct.''

    So what do I do now guys. Any advice would b fantastic. I can't remember paying anything on this debt or when it was taken out or even having any other paperwork for it.

    Do I also send a cca request to optima legal services who is the other name on the claim form as well as Cabot.

          I'd do the first steps, you've already acknowledged and sent a CCA request to Cabot (as claimant) so just send a CPR request to Optima Legal - agreement, default notice, notice of assignment.

                    Hi guys just writing out my cpr letter. It says I require inspection of the documents ahead of filing my defence in such and such a date ???? What date do I put. ? Do I have 28 days from date I received the claim or the date court receives my acknowledgement xx

                        Thr date of the claim is 16th April. What date do I put on thr cpr request plz. Want to send it off tomorrow

                          Hi guys well no news from Cabot. But a letter arrived from optima basically says they have requested the documents from their client and will b in touch in due course. And the account shall b on hold until this time.

                          What do I do now ? Can someone help me with my defence please as due end of next week. Also moving house in 3 days so trying to get sorted before I lose Internet. Any help would b appreciated.

                              Acknowledge Claim - within 14 days from Service

                              Defend Claim - within 28 days from Service (IF you acknowledged in time)

                              If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
