    a further question if you dont mind, the claimant has filed a documents list but is now refusing to allow the defendant to view documents on their list ? is this right, this is a fast track claim now?

    If a part has declared a document in their disclosure index, then the other party is allowed to inspect it, subject to certain points. Full info at CPR31.1, here:

    As per mystery1, if it's not forthcoming, CPR31.12 deals with one's right to make an application for an order for specific inspection of documents.

    It is preposterous to rely on the reason they are and, given it's on the fast track, they're playing a dangerous game.

      thank you for that, i believe they are trying it on, i will recommend a further request, giving 7 days to comply and then if they still refuse consider making an application.
