  • MKDP LLP

    I have just received a County County claim, in respect of a bank loan which I defaulted on. I'm a pensioner and now have to live on benefits, including housing. I live in a furnished flat and have very little in the way of assets. I, even, sold my car, for scrap, over 2 years ago as I couldn't afford to run it any longer.

    These people used to phone me constantly and I explained my financial position to them. They have have now decided to sue me. I don't deny the claim but, would hate to have bailiffs come to my flat as my landlord would, probably, ask me to leave. At 72 years of age, the thought of being homeless is making me very depressed.

    Please can somebody help me?

    Hi. welcome.

    Bailiffs are very unlikely, even if a CCJ was granted.

    Debt collectors like to throw threats about them around, but they are very rarely used by them for things like consumer loans in the County Court.

    Not just that, but you should have notice they were being used in time to apply to the court to have them stopped. For a consumer debt it's not something to really worry about.

          I always forget get that. Yes, acknowledge the claim saying you intend to defend. That gives you more time, and it doesn't commit you to actually doing that in the end.

                    Hi @Sleepless - If you follow the steps I've quoted below from Ame's thread, it'll get you started Please try not to worry ... there's people here on LB who will help you every step of the way!

                    If you are unsure of any of those steps then please make a new thread on the forum (you must be registered to do this)

                    Once those letters have been sent off you should make a new thread on the forum (you must be registered to do this) and make a post titled the claimants name v your username, and containing the date of issue from your claim form, date of service (ie when you received the claim form), type out the Particulars of Claim (exclude account numbers) and tell us the approx amount of the claim. Also tell us any specific disputes or background to the claim you may have. If you know please also tell us the last time you made a payment towards the debt or acknowledged the debt in writing, and confirm you have acknowledged the claim, and what letters you have sent off.

                    NOTE: The defence date is 28 days from service (ie when you received the claim) or 33 days (which allows 5 days for service) from the issue date printed on the front of the claim form.

                        Please don't worry the people on here are absolutely fantastic and will help you every step of the way my dad received a claim from MKDP for a Lloyds loan and with lots of help from Nem on here the court claim was cancelled you have nothing to give them so they are flogging a dead horse I know its very easy to say don't worry but please don't
