    Okay - so just a wee bit of advice here.

    Years ago (2009) i moved out and took out a mobile contract with 02, i decided within my 'cooling off' period i didn't want it.. I called 02 and told them this. they told me to take it to the local 02 store.. which i did straight away.. When i got there they called o2 themselfs because they couldn't cancel it there and they even told them that everything was unopened etc..

    Anyways.. nothing could be done so i went back home and called o2 back and they then denied all knowledge of advising to take it to store and it had to be back in there posession by the 14th day and not change your mind on the 14th day therefroe they wouldn't cancel it..

    After a while i admitted i'd have to keep it and used it for a couple months but couldn't afford it.. stopped paying it and then started recieving letters from Lowell constantly.. I did begin to pay them (i think) but i did dispute it with o2 who said they had no record of the calls.

    the Default is 6 years old in April this year and i have just started to recieve letters threatening CCJ's

    first one was Pre legal assesment
    second one (today) was the same but offering a 40% discount..

    I'm not sure wether this debt is now statute barred and if they're just trying a last ditch attempt to get me to pay up beffore they lose it all together.

    See attached image for what the CRA says about the account.. maybe you can make sense from it.

    Hi Welcome to LB.
    When exactly was the last payment made to O2 ?
    If you go by the default date there is exactly 1 month before the debt is statute barred.
    BUT the last payment ( could) be as much as 6 months prior.
    Lowell are known to claim the default date starts the 6 year clock but that applies on to HP type agreements.
    When did you receive the 40% discount offer?

      I'm not entirely sure when it was but it was before the first record of Lowell on my credit file obviously. does it become statute barred from teh default date or from teh last time i paid lowell something?

          Let's try a prove it letter to Lowell.
          e.g.

          Ref: use Lowells:

          Sir/Madam,

          I am in receipt of communications from Lowell dated XX & XX in which it is alleged that I owe a debt for £ xxx..xx originating from an account with O2, please not I do not acknowledge any debt to Lowell.
          I am unaware of the existence of any such debt apart from the recent correspondence received from Lowell, therefore I require unequivocal proof that I have any liability for the alleged debt and I am unable to reply further to the recent correspondence.

          Send by signed for post.

          Give us a little time to establish the date of the last payment.
          If you have an account No. there is no harm in asking O2 when the last payment was made.
