    Issue Date: 17-2-2015
    Amount approx: 780.96
    Claimant: Arrow Global Guernsey Ltd
    Solicitor: Blake Lapthorn
    Original Credit: MBNA

    Particulars of Claim:
    the claimants claim is for the sum of £650.96 being monies due from the dependant to the claimant under a regulated agreement between the defendent and MBNA and assigned to the claimant.

    Notice of the assignment has been provided to the defendant. The defendant has failed to make payment in accordance with the agreement and a default notice has been served pursyant to the CCA 1974.

    AND the claimant claims the sum of £650.96 together with the costs of this claim

      I've just posted on a similar thread, sooo many claims for SBd debts!
      Below are the first steps to take upon receipt of a claim. You have a total of 33 days from date on claim to submit a defence, this useful calculator gives you up to March 22nd: http://www.timeanddate.com/date/date...&am=&aw=&ad=33

      If you are sure this is SBd, when the time comes, you can just submit a SBd defence. The idea behind requesting documents, etc. is to have a back-up plan in case they come up with something such as a payment you made in 2010, something like that, it does happen!

      So, first steps (within 14 days of receiving the claim)

      1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
      You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

      2: Send A CCA REQUEST to the CLAIMANT ( see here )
      This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


      3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

      This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

          Check your credit reference files, Noddle is free online, Equifax and Experian have 30 day free trials just cancel before the 30 days expires otherwise you will be signed into a subscription.
          If the account does not show it will have been removed after 6 years from the default date so you will get some idea of the age of the debt.
          SB in England/Wales = 6 clear years no payment (to any party) or written admission of liability. ( no court claim issued in the relevant 6 year period)

              I sent both letters recorded delivery on 26/02/2015

              The reply from Blake Lapthorn (dated 27/02/2015) reads

              "We refer to your correspondence of 26th February 2015. We have requested documents accordingly from our client and will forward the same to you as soon as they are received by this firm. We are returning your postal order in the sum of £1.00 since this is not required given the nature of your request."

              In my letter to Blake Lapthorn (from a template on here) I told them "You should ensure compliance with your CPR 31 duties and ensure that the document(s) I have requested are copied to and received by me within 7 days of receiving this letter." They have failed to meet this deadline - what do I do now?

              The reply from Arrow Global (dated 06/03/2015) reads

              "Thank you for your letter dated 26/02/2015 received on 05/03/2015. We acknowledge your request for documentation pursuant to the Consumer Credit Act 1974. We will now process for documentation from the originating creditor and will revet in due course. All collection activity will be suspended pending provision of the documentation"

              In my letter to Arrow Global (from a template on here) I told them "I understand that a copy of my credit agreement should be supplied within 12 working days from the date of this letter." Which they'll breach next week. - What now?

                  That is correct, there is no fee for the CPR request.

                  Chase them up, to save time you may want to phone and/or email them and say that, as they have failed to send you the documents you requested, which should have been in their possession when they issued the claim, would they kindly agree to a 28 day extension to file your defence which is the maximum allowed under CPR15.5. If they agree, ask them to send you an email so you can forward it to the court. :typing:

                  The above is a template letter used to reply to all CCA requests and not tailored to those cases where they've issued court proceedings. You should therefore ignore the bit about all collection activity being suspended, you still need to file your defence in time. :clock:

                  Otherwise there's no need to chase Arrow for the copy of the agreement, since failure to comply within 14 working days can be used in your defence. You only need to chase the solicitors and see if they agree to an extension.
