    thank you so much for all help so far, I wouldnt know where to start without you.
    I have sent my CCA and CPR and need to fill my defense by 16th Feb ( as per Kati's calculation)
    I have a question, [MENTION=55034]nemesis45[/MENTION], [MENTION=49370]Kati[/MENTION], [MENTION=58830]Nuff55[/MENTION], what should I write in my defense, its unlikely that cabot and mortimer will come back to me before the 16th as I only sent it yesterday, so what do I base my defense on? is my personal situation any important here too, or should I not mention it at all?
    any ideas will be much appreciated

          I'm not sure if it's a midnight deadline, but maybe [MENTION=55034]nemesis45[/MENTION] or [MENTION=5354]mystery1[/MENTION] will be able to answer

            I am struggling a bit with my defence as I haven't heard back from solicitors about CPA and CCA, I am just looking at the templates here and trying to use it. I am panicking now big time. I hope it is till midnight

              Please try not to panic ... I wish there was more I could do myself, but I'm not very clued up on court cases (yet)

                  9. On the [DATE] I sent a formal request for a copy of the original agreement to Lowell Portfolio pursuant to section 77-79 of the Consumer Credit Act 1974 along with the statutory £1 fee.

                  10. The Claimant has failed to comply with s 77-79 Consumer Credit Act 1974 and therefore cannot enforce the agreement.

                  13. Under Civil Procedure Rule 16.5 (4) Where the claim includes a money claim, a defendant shall be taken to require that any allegation relating to the amount of money claimed be proved unless he expressly admits the allegation. Therefore It is expected that the Claimant be required to prove the allegation that the money is owed as claimed.

                  14. I request the court orders the Claimants to provide the necessary documentation in order for me to fully plead my case else the Claim should stand struck out.

                  15. In the event that the relevant documents are received from the Claimants I will then be in a position to amend my defence, and would ask that the Claimants bear the costs of the amendment.

                  16. It is denied that the Claimant is entitled to the relief as claimed or at all.

                        Phone up Mortimer Clarke right away (before they shut) and see if they'll agree an extension under cpr 15.5 as they've failed to supply.

                          Confused am I Capital One in thread title? Lloyds bank in para 3.

                          Lose the Bold type in para's 1.7-8.

                          para 7 edit out " trying to find out more information" and just use the rest. I.e on xxxx I sent etc.

                          Otherwise good to go.
