Back in December 2014, I received a County Court Claim Form from Northants saying that I owed a creditor in the name of Cabot Financial, the sum of £9,000.00 including legal fees.
I have had no prior dealing with Cabot Financial so I sent back Acknowledgement and defence on basis that I did not owe the creditor. Court advised receipt of my forms and advised that copies sent to claimant.
On 20th Jan this year, I received letter from Restons Solicitors, acting for Cabot, which informed me that the debt was from a previous credit card which I had taken out with LLoyds in 2003 and this had now been assigned to Cabot in July 2014.
Restons further explained that I should have received communication from their client, Cabot, and a Notice of Assignment.
I have not received any communication from Cabot and do not recall any such 'Notice' from lloyds.
Restons further suggest "In light of the above I would be grateful if you would withdraw your defence. If you fail to do so we will make an application to 'Strike Out the Defence'...
Not sure where to go from here
