  • Court Claim - cabot financial / lloyds - 9-1-2015

    Issue Date: 9-1-2015
    Amount approx: 2809.19
    Claimant: cabot financial
    Solicitor: restons
    Original Credit: lloyds

    Particulars of Claim:
The claiment claims payment of the overdue balace due to the defendants and under a contract between the defendant and lloyds bank dated on about oct 08 2007 and assigned to the the claiments on jun 24 2014 in teh sum of 2624.19

    Stat Barred? No

    Have sent:

    Other Info:
The reason this has been dragging on is that in 2010 Lloyds put me on a payment plan (as i had just graduated and was unemployed, )via the overseas call center, despite me asking over and over again they never acknowledged this and I was told to ignore my statements .. in 2012 My account was passed to a debt collection agency ( without any notification ) the amounts shown on my statements therefore I believe are incorect to what I was being told on the telephone, I tried to use the financial ombudsman but it was outside the 6 month window. I have tried over an over to get lloyds to acknowledge this and feel they have treated me unprofessionally and acted dishonestly.

I am unsure if I need to accept part of claim and if so how much or just accept etc. many thanks

    Hi Lilly

    Welcome xx

What kind of account was this ? current account/overdraft or a credit card / loan etc ?

We need to know that first, I'm guessing at overdraft.

Okay credit card is fine. No the Lloyds and TSB split doesn't really affect things.

So, first steps (within 14 days of receiving the claim)

1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

2: Send A CCA REQUEST to the CLAIMANT ( see here ) Needs a £1 postal order
This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.

3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

see This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

We'll get those letters off first, I'd also like to send a Subject Access Request to Lloyds to get information about this arrangement and how you balance was affected through that time.
