Not enough people complain to the FCA when Lowell pull these tricks, a far greater
number of Lowell cases are out there we see only the tip of a very large iceberg so
many people give in as soon as claim is received, either failing to respond and getting
a CCJ by default, or paying up before the claim gets to court.

So a complaint to the FCA would be a good idea then........more complain, the more likely that some action will be taken against lowlifes

Old discussion= as it is most cases won , change the way they operate then loop hole gone. case possibly lost on that front which most cases are won.

I've been wondering about this all along, although they have changed their tactics a bit since the FCA took over from the OFT. They used to issue statutory demands instead of court claims, and most were dated two or three weeks earlier than the date they were served, hand delivered so no chance of them being stuck in the post. This was intended to make the recipient think they'd missed the deadline to apply for set aside. :mad2: :mad2:

Now they are issuing claims for SBd debts they make up phantom payments or make up their own rules, for example, that the default date on the CRA is when the clock starts to run, that after they often 'update' the original default date themselves. They are a bag of dirty tricks!
