    oops. Need to eat a large slice of humble pie with an extremely red face. It would appear my information is incorrect, how time fogs the mind.

    After an extensive house search I have now found a receipt for a small monthly payment made on the 30th October 2008. However this does appear to be the last payment made as i have letters for November 2008 and thereafter stating that payments have been missed. Having moved the goalposts myself does this still add up to being Statute Barred and what about the Statutory Demand in September 2013. Any Help or guidance please.

      If the stat demand was set aside then it does not stop the clock.

      Last payment being 30th October 2008 - it matters a lot when the claim was submitted to the court.

        Not sure if the SD was set aside nor am i sure of the date of the Court Claim ( i suspect mid October 2014 ) because i never received the paperwork as it was sent to my neighbour's address. The CCJ was obtained on 5th December 2014

          Probably late October yes. Sounds like the Stat BArred defence has bit the dust then sadly.

          Are you applying to set aside the Judgment ? I think you should, but If not you will need to apply to vary the judgment so its at the right address and set up installment amounts. Do you own your home?

          Did you get a CCA request off ?

            Not really sure what to do or in what order. If the Stat Dem, Court Claim and subsequent CCJ have all been posted to my neighbours address{ 14 }and all corrospondence since 2012 instead of my address{ 14a } is this my first line of defence.

            Has the claims procedure been excecuted properly, is there Data Protection issues etc. Any help/guidance would be much appreciated and thank you for your replies
