  • Letter before action - Greenbelt Group/Optima Legal

    Dear All,

Since July 2008 I have had a problem with a land maintenance company called Greenbelt Group. I believe that this company does not provide a adequate service and have failed to respond to my concerns. Back in March 2009 I stopped paying this company due to their lack of service. This is also well documented throughout the UK.

Today I have received a letter from Optima Legal explaining that they have now been instructed to chase the outstanding monies of £982.81, otherwise they will issue court proceedings in 14 days.

An application has been submitted on the 01/09/2014 for a judgement on whether these burdens are illegal and unenforceable. Could anybody suggest whether I should write to Optima explaining this and request that any further legal action be suspended until after the test case?

Ha! No. I'm definately not GB. I'm subject of court action as well. However now that this test case has set a presidence, we'll see how they get on in court with me!

They will back out the day before, they did it with somebody on my estate, they just want to force people to pay through threats and intimidation.

If you need help with anything let me know and let me know how you get on. I just think it wont get to court and you wont be able to show the court what youve got on them. If you have received anything legal from Anne Shiton point out to the court that she isint registered in the UK as a solicitor but signs her letters as a solicitor. Shes registered in Scotland but on the UK.

Hi . I bought my home 5 years ago in northwest England . Recently as the estate has just finished completion I have received a letter from a company called greenbelt informing me that they will be taking £160 per year from the 224 houses within the estate . After briefly doing some research about this company I was shocked at what I found . the fact that u cannot get rid of this company as they are legally written into your housing deeds. How is this allowed by law ? And unlike a gas or electric company etc u cannot move companies if you don't like the service or price . Most of the people on the estate are not happy about this . I sent an e mail to greenbelt which was met with a patronizing reply. Some people are saying they will not pay the bill etc , green belt have arranged a meeting with the residents for 3 weeks time . If there is anybody that can provide Any information or advice on how to deal with this company it would be much appreciated . Is there a Facebook page ? Or group etc set up to fight this ?

Hi had the same on my estate never paid. Get a letter every other week about going to court told them to bring it on. One thing you can do which they hate is take them to a leasehold valuation tribunal just Google it. On our estate it cost £10 each and they cut the bills by 200 % from 300 to 100 per year. They where forced to give us refunds on what we had to pay when we moved in. If you get any letters let me know. Also visit the webpage of the lease hold advisory service look at section 21 of the landlord act. It makes very good reading and proves they have no case to answer. Also Google RX3 form at the land registry send it to them asking for your burden as it is know to be removed.. if possible get rubbish on your estate to do it. They won't like that. Also they have a solicitor who isn't registered in the uk but yet sends letters quoting uk.law saying she is one. Best advice don't pay its all a bluff.
