  • Defending a claim

In most cases, creditors and debt purchasers shout but fail to act. What to do if they actually decide to act and serve the court papers?

Thankfully, there's a lot of information avaluable online. If you have found this site you are definitely in the best place and all advice is free.

Alternatively, there are a number of legal services services that charge for their services available on the internet. If you choose to take this route, at the very least you should check whether they have an appropriate indemnity insurance. This is to protect you in case things go wrong. You should also check how qualified their advisors are.

I recently came across a firm where their solicitor was a non-practising one. My question was why they weren't practising? Were they retired (which would be completely acceptable) and, even more so, could indicate they would be very experienced in their field.

Or could there be something more sinister such as suspension by the Solicitor's Regulatory Authority?

Hiring a traditional firm of solicitors is often the best idea but can be costly, especially if the costs are not recoverabe. Using online services is a cheaper option but the above questions should always be asked.

Just a few more points. When using online legal services you may still wish to ask who is going to be dealing with your case. There are many various services available. Some just answer simple questions for a small(ish) fee and some assist you when you are acting as a litigant in person.

You may also wish to run a bankruptcy check on any online legal professional you are looking to use.
