Can someone please help.

I was taken to court by BW legal on behalf of CL Finance. I was in talks with them and agreed to pay £60 a month. A few days later I received a letter to say that they had set a date and there was several forms for me to fill in.

I sent a full financial statement and several bank statements to them with the forms. The result from the court was that i now had to pay £250. Which is way outside my means. I contested the judgement, But I unfortunately got the wrong day for the hearing and again I was told to pay £250.

I have tried to speak to BW legal and said I could not pay and they said I could as my financial breakdown showed I had £300 spare per month. I if I could not pay then I had lied to the court.

I have asked BW Legal for a copy of my case and they will not reply to my request..


What can I do now.

Do you have a copy of the most recent court order you could post up. It sounds like you applied to vary the original order and then missed the hearing and the court stuck with the original amount. Might help if we can review your income and expenditure forms to see what the issue is there.

I have tried to get a copy of the income and expenditure forms fro BW but they say I will have to pay for them.
I tried to arrange a repayment agreement but the wanted to go to court.

Income Expenditure forms for court attached - you should have had these when BW Legal first sent the case to court ? When you completed those and sent them back did you send it to the court as well ? Just checking what happened here so far.

If your income and expenditure does show you can only afford £60 a month then you can apply to vary the court order - this would be form N244 and would cost £50 or £155 unless you are eligible for fee remission - see form EX160. Possibly that's wha BW legal mean about paying for the forms.

Did you speak to the court at all about not attending the hearing for you original variation application ?
