    First post so please bear with me if I go off on tangent ,

    Having lost my business and my property in a fire in nov 2012.I am still trying to get insurance company to pay and have had to take legal proceedings against brokers for negligence .I still have had no money and it looks likely that I will have to settle for commercial offer of 20% of claim as I do not have funds to fight case .

    So as you can imagine the last 20 months have been a nightmare, having no business no way to pay debts and having to borrow from family and friends to fight insurance claim which is in the region of 850k.

    So having various legal dealings over the last 20 months and numerous collection agencies trying to contact me every day ,I have explained my situation and as I have no assets until the insurance claim is sorted out.

    The majority of debtors have given up and the bank have told me to deal with collection agency if I want to make an offer on outstanding mortgage as bank agreed sale of land and there security has now gone ,so I guess that they have sold debt on and written it off,

    But Saturday I received a court summons from a MKDP for an old Barclaycard amount which I advised of the fire and told them the situation and sent them a letter 18 months ago saying could you please provide CCA to see if I was entitled to payment protection the balance was over 12k

    I never received a reply

    The summons received from MKDP they have spelt my first name incorrectly and say the debt was from Dec 2012 which was the last time I paid them .I would dispute the debt as I believe I have PPI and also there is no way I have the funds to pay as it looks like I will have to accept 20% of insurance claim .

    I have been told that because of the length of time I have had the card that the original CCA would not be available and this would stop any court action .If I have to pay all of my debts in full and only receive 20% of insurance claim I have no alternative but to consider personal bankruptcy.Please could you give me your opinions

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
