County court claim From Drydensfairfax for their client Capquest

  • County court claim From Drydensfairfax for their client Capquest

    Received cc claim on 5th July (dated 30th June).

    I duly acknowledged claim claim with the County Court stating I intend to defend.

    I sent CPR to Drydens and CCA to Capquest.

    Received letter from Drydens who state "we confirm we have contacted our client for their further instructions and confirm this matter has been placed on hold"

    received letter from capquest with an entirely different reference, company and amount owed. They state "we have forwarded your request for documentation under the Consumer Credit Act 1974 to Egg Banking and will send this documentation to you as soon as we receive it"

    as as the court claim was originally with Citibank under a different ref.no. And different amount what should I do now.

    I did reply in writing to Drydens asking what "on hold" means and reminding them of the details in the original CPR letter. Have not had a reply to this.

    All correspondence from me has been sent special post.

    what do I do now?

    You are running out of time to file your defence. I make your deadline (28 days & 5 for service) the 2nd of August. :clock:

    I wouldn't trust them! :lie: There was a recent case on here where the claimants also sent a letter saying it was "on hold", then applied for default judgment! :scared: :mad2:

    Once you are in court, the only way to put things "on hold" is to ask them to agree to an extension and send you an email with their agreement so you can forward it to the court. :typing: You could still try to ring them tomorrow asking for up to 28 days as allowed under CPR 15.5. hone:

      This would be their response to the CCA request, it's a standard debt purchaser's response since they wouldn't have the documents and would have to go back to the original lender. The Egg portfolio was bought by Citi who in turn sold them to Barclays in 2011. I've also got one of them 'bad Eggs'.

      Sounds to me like one of their standard templates they use.

      As time's not on your side, we need to get a few details about your account: :clock: :clock: :clock:
      When did you apply for the Egg card?
      • If you applied from Jan 2005 onwards, was it an online application (if earlier, it's not important)
      • When did you last make a payment?
      • Did you receive a default notice when you stopped paying?
      • Have you got a notice of assignment to Capquest?
      • How much is the claim for?
      • Have you ever disputed this account or sent a CCA request in the past?
      • Was there any PPI?

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
