      Cool Sit tight see if they apply to lift the stay.

      The issue date was 1st April so they could apply for default judgment just after the 33 days allowed (6th May is about 35 days?)- so probably your defence was received about the same time they applied for default judgment, so it was refused. So the court should go back to them giving them 28 days to respond to defence, which they haven't done thus the claim is stayed until they pick it up again. I don't think you need to do anything until/unless they do pick it up again, if they do you'll receive notification from the court and a directions questionnaire and we can look at it again then.

          Hi Flaming Parrot, the charges amount to £619 and I do not owe the money to this company Lowell's. I have spoken to the court and they said the account is "stayed" (hope that is correct) !! Thanks for your reply btw

            Lowell would have bought the account from Lloyds. Now the case is stayed, they would have to apply to the court to lift the stay if they wish to proceed. If they decided to do that, you could negotiate a settlement minus the charges, possibly via a Tomlin Order to avoid a CCJ. :thumb:

            Not immediately relevant but always good to know what your options are.

                Flaming Parrot - If they (Lowell's) did not proceed with this case then what do you think would happen then in this instance ?

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
