  • debt collectors.

    hi. i just wondered why is it that when debt collectors buy a debt say from a financial institution i.e banks they cannot get hold of the paperwork that forms an important part of their claim.i have had a case with mkdp who put me in court without any relevant paperwork. regardsto all chindit.a

      hello.yes i defended as statute barred.but i also sent a sars to mkdp they havent produced a scrap of proof of the debt. it is three months now not a peep the court case is stayed. regards chindit.

        Debts are bought in bulk without paperwork, counting on debtors to admit that they owe the money and pay up. The vast majority of money claims are not defended, since the defendants would either do nothing and get default judgment against them or just admit the claim, since they know they had the card/borrowed the money/bought the goods, etc. they wouldn't think of defending. :tinysmile_cry_t:

        The onus would be on THEM to prove it's not SBd, not on you that it is. :thumb:

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
