    Hi,
    Just after a little bit of advice please

    Long story short, i had an account with Littlewoods/Shop direct and had multiple problems in 2010 (being charged for things i could prove had been returned etc) so refused to pay until it was sorted,having spent 2 hours on the phone to them on multiple calls with nobody doing anything!
    I didn't hear anything for a long time and then eventually it was passed to Lowell. I explained the situation and CCA'd them and after lots of letters saying 'we are still waiting on shop direct' they eventually sent me a letter stating it could not be found and the account had been closed - i still have a copy of this letter.

    Fast forward to April 2014 and I have received a county court claim form from Northampton CCBC. The same day i got a letter from Bryan Carter that starts 'As you have failed to make repayments...'
    Repayments on a closed account??!!

    Yesterday I submitted my AOS as 'defend in full' but have no idea how to word my defence?
    I originally thought something simple such as 'The defendant denies the claim due to receiving a letter from Lowell stating the account had been closed' but after looking through this site it seems it needs to be written in legal terms (i hope that makes sense!) and i have no idea where to begin!
    Any help would be greatly appreciated :tinysmile_kiss_t4:

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
