  • i've been stupid....need help with Bryan Carter

    Dear All,

    I received a claim form from Northampton for a debt of 354.66 to Orange, on behalf of Bryan Carter Solicitors, dated 25th February.

    immediately rang BC and stated that I hadn't received any letter at all regarding this until the claim form turned up. BC said I could settle the account in full within 30 days from date of claim form without a judgement being entered against me.

    I was made redundant a week after the claim (started a job this week thank god), and am unable to make full payment. I could make a token payment tomorrow, if that would help

    Due to some bad advice, I filed an acknowledgement of service TODAY, but not sure what difference it would make (if any). I also learnt that a claim is considered served 5 days after the date of claim (which may buy me a few extra days).

    I guess what i'm asking is, is there anything I can really do? other than call BC tomorrow and hope that a token payment may suffice till next month? I get the feeling from what I have read elsewhere that these claim forms are a scare tactic and they are unlikely to take it a court when i could claim time to pay and offer a pound a week. I'm sure they'd rather get my money quicker than that.

    Any help is much appreciated.

    You could phone them and try to settle. It's hard to advise without knowing details, the smaller the amount then the better your bargaining position is as it'll cost them more to go to court than they can win.

    Without detail it's hard to say what to do. Normally for a defence a cpr 31.14 request and a cca request should be done but if you're settling then it's not worth it.

    Defend Claim - within 28 days from Service (IF you acknowledged in time)
