    Hi Guys,

    I called the court this morning to check on the status of the case. Apparently the files have been with a district judge since 23rd April and are being considered - no ruling as yet. Does that sound good or bad? :-/

    According to the order (that they ignored) after they served their evidence I had until 12pm today to serve my defence. Obviously I haven't sent in anything as they have not complied with the order but getting paranoid in case the judge is waiting to receive it today and may rule in their favour when I miss the deadline......as you may guess I'm a glass half empty kind of gal so will always assume the worst possible scenario! Getting myself in a state about it all now :-(

      When you spoke to the court did you tell them you had received nothing so to make a note on the case file that you hadn't responded to their evidence as you haven't received any? The court will know they haven't complied with the first part of the order already, but it might help set your mind at rest if you make a point of informing them that you haven't been able to fulfil your part of the order.

      Ah just read back a bit
      I called the court and they said that it could take up to 10 days for it to be struck out so I have emailed the court also - reiterating that the judge confirmed the dates with myself and the Claimant's representative twice during proceedings
      that'll be why the file is with the Judge.

        Thanks Amethyst - I guess I just need to calm down and wait then!

        Does it mean anything that the judge has had the files since Thursday and not ruled yet?

            Ok so no news yet!

            I called the court today to see if anything is happening but the only activity they have noted is that the court sent a letter to MKDP on 29th April.

            I'm guessing that it if was going to be struck out it would have happened by now? Hate being in limbo.............. :-(

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
