    reciept of court claim im willing to settle

    Hi,

    I have recently received a court claim and I am in a position to settle the amount in full as the details in the claim are correct and i do owe the money. Do I need to acknowledge the claim via the HMCS Money Claim Online or do I just contact the creditor to make the payment??

    You can pay the creditor and invite them to withdraw the Claim, or you can file an admission using the claims pack and then pay.

    What are you looking to achieve here , thats the question?

      Thanks for the response. Im looking to pay the debt without a ccj being registered.....

        If a judgment is made, then the CCJ only gets registered if the debt isnt paid within 28 days i believe.

        Perhaps you could settle with a consent order? does the claimant have solicitors acting?

          i only received the claim today so ive been a bit flustered!! will have to research a consent order as dont know what this is, im not sure if they have a solicitor acting

          NOTE: If you receive a court claim note these dates in your calendar ...
          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
