  • dvla summons help please

    Hello*


    The dvla has taken me to court for not notifing them of a new keeper of a car, the dvla issued a fine in march 2013 and sent it to my previous address, the car was sold through a motor auctions and then kept sending these to my previous address and the a court hearing was heard in my absence in the 7th november 2013.


    The court did a search and found my address,*they are sayin they are going to reissue me another summons to attend court. I have tried to contact the dvla just so I can pay the original fine and put this matter to bed and they say no its a court matter. If I didnt get the fine to start with how can they take me to court. If I had the fine I would have asked what it was for and then paid it.

    I have nevet been in court and its rather worrying

    One question, Maverick - Did you return the relevant section of the V5C to DVLA?

      I sold the car at auction with the green new keepr slip as I didnt have the log book, I asked the auction house if this was ok they said yes and advised me that the new keeper will fill out a v62.

      What im getting at is if I had the original fine sent to me I would have paid it instead of going to court.
      Also will I get a criminal record for this with it being in a magistrates court?

        Okay. A few questions -

        1. How come you did not have a V5C when you sold the car through a motor auction house?
        2. Are you a motor dealer or in the motor trade?
        3. Have you, at any time, held a V5C for the vehicle you sold through the motor auction house?

        The reason I am asking these questions is to establish whether you have, in fact, committed an offence, or whether DVLA is attempting to gain a false conviction and fine.

          I didnt have the v5 as I swopped my car for the car in question I had it a week then sold it via the car auction im not a trader I just had a bad car and wanted to get rid of it.

          I sold the car via the auction with the green new owners slip, the auction advused me this would be ok and the new buyer will fill in a v62 to get the log book. I wadnt aware I had to write to dvla advising them I sold the car without the v5.

          I can not recall having the v5 log book as I moved house end of November.

          I have tried to contact dvla to pay the original fine as I would have paid it to start with but they say I cant it has to go throufh the courts

            You MUST have had the logbook for the vehicle and it MUST have been in your name, otherwise the DVLA wouldn't have chased you, they would have been chasing the previous keeper, DVLA are many things (incompetant, bullying and not fit for purpose), but they are not mind readers!

            So, from what I can gather then, you DID have a logbook, the person you swapped with sent the logbook off with your details and gave you the green slip, so as far as the DVLA are concerned, YOU are the registered keeper.

            Now, i'm not one to defend the DVLA and having had a brief run in with them involving a clamp (a boot full of tools soon enabled the clamp to vacate my car undamaged!), I really shouldn't, but i'm afraid this ones on you.

            It is your responsibility to notify the DVLA if you have sold the vehicle, its not the auctions, nor is it the new owner when the car sold at auction, in fact, its in their interests to NOT put the car in their name so they can drive it around knowing any fines or parking charges won't be going to them.

            What you should have done is wait until the new logbook came back to you, and then take the car to auction with the logbook.

            However, all is not lost, especially as I don't like the DVLA and maybe the removal of tax discs could be the beginning of the end of them as the government go a route of charging road tax to fuel, but I digress.

            Did the person you swapped the vehicle with filled out the logbook on your behalf and sent it off on your behalf without your knowledge?

            Answer that one, and then we'll continue.

              I think what's happened is I moved house before I got the log book and the fines have been goung to my previous address I dont have a problem with paying the fine if I was given the chance
