  • Civil Enforcement Ltd Northampton County Court

    Hi,
    Ive read loads of posts from people telling me to ignore all letters etc from Civil Enforcement Ltd which i did. But now by doing this I have had a claim form from Northampton County Court with reference number and stamp. Looks like it was the wrong advise from everyone. WHAT SHOULD I DO???????????????????

    Hello Cherpont,

    We seem to have a few of these at the moment, yet the advice has not changed, and nobody has been able to post up a link to sites where they've read a different opinion.

    If you have received court papers then you need to defend the claim. It does not mean the advice was wrong, it means you need to get together a defence and make sure you turn up at court to defend your case. I would recommend posting this up on Pepipoo for advice as this is the area in which they specialise. If you read the forums there, you may get some ideas about what others have done in the same situation. It tends to be those who do not turn up to defend who get default judgments against them.

    Can you point me to any of your other posts please - maybe you had a different user name before?

      I too am at the same stage as yourself - I ignored all the letters and eventually had to complete the ones that came from the court, Case is now listed for Jan in small claims court!!. Where are you up to now with advice etc.

        Post up the particulars of claim and any documents and pictures of signage blanking out you name address reg number etc.

        CEL don't do court very often but have issued many claims. Often they don't payy the hearing fee and thus lose. Sometimes they quit a day or 2 beforehand and recently they went to Watford court and lost. (details scarce but it is a win)

        Make sure you login using the password on the claim form and acknowledge the claim and state that you will defend in full which gives you a total of 33 days from the date of claim to lodge a defence.

          At what point would such shenanigans result in their being declared to be a vexatious litigant?

            I guess it'd depend on how many default judgements and actual hearings occur.

            I would also guess that the Judiciary don't pay much attention and receive very few complaints.

              Acknowledge Claim - within 14 days from Service

              Defend Claim - within 28 days from Service (IF you acknowledged in time)
