    I would suggest you do some more reading. You can Google and also use the search facility on this forum.


    Use the advanced search for single content, use the phrase 'application to strike' in all open forums and show the results as posts.

    Read through those that seem to apply to you. Google and LB are your friends! Use them. Do your own research before venturing further.
    They were out to get me!! But now it's too late!!

      I've been reading the Justice.gov.uk procedures and although they are very informative, they tend to talk a lot of legal jargon or phrases that make little sense (to me), so its often nice to have a clearer view in layman's terms on what to do and when.

      I'm going to leave this till the 1st Feb and then I will call the Court and ask them for some advice. I doubt they will give it to me directly as I want (as in "yes, you should apply for a strike out and here's how you do it"!) but its the first step.
      I was reading somewhere that to apply for a strike out I need to a special form (N288??) and it will cost me £75?? I suppose I could put that £75 in the strike out claim but that is bound to upset the claimant and make them more defiant in their pursuit??

      The upshot of all of this is that I know they don't have a signed agreement and there is little other documentation they can produce.
      About 18 months ago I got a threat from another DCA about this same debt and I responded with the usual application for documents (can't remember the name of it - it costs £1), and they panicked then. They sent me holding off letters and then finally produced a printed version of the agreement with my name printed on it. I wrote back and told them they were firstly late with their response and secondly it was not correct as it was not a signed copy.
      And now this has been passed on to another company who I think are just trying their luck after a few threatening letters.
      This debt is over 5 years old (which doesn't mean a lot) and I tried my very best to resolve this with the original lender, but they never responded to any of my letters. They simply went straight down the recovery option which really annoyed me.
