    Hi All, Me Vs Lombard Vehicle management

    I'm a newbie, I also want to overturn my CCJ. I Had a personal lease car from JamJar which was underwritten by lombard vehicle managment. I had a 3 year lease agreement started in 2008. I ran into dificulites in 2010 paying my lease and had made and several payment arrangements to clear my arrears which i was making but was finding it hard so I decfided to turn in my car early under the early termination rules of the agreement. everything was going well, car was collected and a final invoice was raised for the settlement which was £804.

    I planned to make an arrangement to pay this off. I didn't hear anything from lombard for months then all of a sudden I get a letter from Blakemore Solicitors demanding payment within seven days.

    They refused to accept any payment arrangement and threated court action. I mistaking thought they were bluffing. They did and filed a county court judgement on the grounds that I was in breach of contract, that I failed to make my contractual payments and they had to forcibly take the car back and caused damaged to vehicle and had exceeded the millege allowance. Non of these claims were true so I thought.

    Unfortunately I didn't respond to the summons in time and the Judgement was made. I then appealed and asked for adjournment. I then asked for the judgement to be set aside because the claims they were making were factually incorrect. I showed the judge the email corresponce made from me to lombard requesting earlier termination and the arrangements that took place for the return of the car plus the final invoices.

    I told the judge I do dispute that I owe lombard money but not on the grounds they were claiming. The judge partially set aside some of the claim. Blakemores then gave me 2 weeks to pay this order which i couldn't they then placed a charging order on my house? £1960

    The lease was not a secured debt so why have they been allowed to do this. Can I get it over turned?
