      Re: liz40's creditor problem

Also I am not sure how they come to this figure?

I have paid back approx 3,000 will need to double check this it maybe more, yet the first loan was £8,000 and the second was for £3,000 apr is 10%?

The N1 says total amount owed is £13627.72 p?lus they want 8% on top from april 2011 to april 2012 and up to judgement

On the N1 it just mention the full amount of each loan not how much I have paid in so its very confusing how can I check this information. I do have loan statement up too the March 2011?

        HI

Yes part of the function of he default notice is to ensure you know exactly how much you owe of course, which is why the act says that one must be sent before any claim can be made.

"The claim has not been correctly particularized, in that it consist of two agreements that have been individually partially repayed."

Please tell me to butt if I'm wrong but do they not have to send you a yearly statement of your loan these days?

So really I should ask them to send me a statement on each loan?

              Re: liz40's creditor problem

This type of thing is not my forte but it is my understanding that if you have an ongoing loan - no matter how old - you have to be sent yearly statements showing what has been paid and what is still outstanding. I believe this came in within the last 2-3 years.

Of course I could be talking gibberish in which case I will get back in my pram but those better versed in this will know the definite article.
