    Re: mickthevic v varde

Looks good to me, though where you mentioned notice of assignment i think you should add True copy of the originally signed credit agreement as well, as without that they can not enforce the debt in court, nor can you deny the agreement if you have not seen a copy of it.

Ohh Scratch the above i just reread it, and you already have mentioned about the written contracts. Forgot i had posted up a embarressed defence for you to use in one of my earlier post too. My excuse is, i was distracted by a long legged blonde walking past lol

WHERE, WHEN how, why did I not see her, was I asleep

      Dam, missed that lol

Defence looks good but I would also add in about a default notice too as they can't assign the debt if there has not been a valid default notice issued by the OC (original creditor)(as if I remember right the one posted up above is not from the OC, is that correct mick) if it was from the OC and the remedy date is BEFORE the assignment date and it also is BEFORE they actually registered the default on your credit history then don't worry about adding it in

either way with the above no matter, but I would also submitt along with your defence, a N244 and an unless order giving them 7 days for the production of the Valid docs required or their claim gets struck out

Like the ones here that was done for Barton in post 62

        Hi
Do I send special delivery or do it on line?

        Or do both?

I think there is a word limit to to it online so you may have to post special delivery anyway

You could try it online and see if it fits first tho

You should only need to do one or the other, and remember to send a copy of everything to the claimant too
