    Hi there, I am glad to join the forum.
    At the moment I have a court claim in progress brought by HSBC. I really need some urgent advice concerning a few legal issues. At present the case is 'Stayed ' pending eithir party making a request to lift the stay. Initially i was being taken to court for a debt outstanding 'under a bank account facility' which I understand is Banking Law'
    However because this was carried out by breaching the Banks own 'Terms and Conditions as I pointed out to them. .
    They have now elected to apply to the Court to 'Amend ' 'Their Particulars of Claim' to a Credit Card under the consumer Credit Act.
    As i am concerned that this will change the substance of the case and wash over their illigal actions, under banking law and start off as almost a new claim.

    Hiya,

    Welcome to the site.

    So you have an HSBC credit card in default, and HSBC have sued you detailing a 'bank account facility', you argued this and the case is stayed - they are now requesting to amend their particulars to correct the classification and lift the stay ?

    What is your defence to the claim ? (other than the bank account / credit card bit)
    Do you have copies of the relevant documentation ? (CCA etc)
    Is HSBC bringing the case themselves or a DCA ?

    Can you post up the original POC and the proposed POC pls.

    If its a simple error on their part which they are now correcting you should be able to get costs to date for the defence and time you have put into the case to date, but I doubt it is enough to keep the case from progressing and denying their application to amend particulars could be viewed as vexatious .

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
