    I'm getting sued by hfc through their sols for about £1000 for a personal loan taken out some years ago . Ive been made unemployed and can't go back to work as my wife is disabled but has been refused DLa (we're appealing) i'veentered a baicdefence as the court papers said i had 14 days to respond. I cant meet hte full payments but the proiblem i have now is that if i end up with another ccj i wont be able to reurnto work as i work in finance and the banks may not see me as a fit and proper person .
    We do take in lodgers at he property and have a turnoverof about £2000 a month although no profits this year because of capital costs . Eqity is not a problem toal mortgage is less than 40% of property value.

    is there any advice for going to court what paters should i take and is there anything else to do?

    Can you post up what your basic defence said Did you complete the Income/Expenditure form on the return documents and make an offer to pay ?

    I don't know how the finance industry and employment works with regards CCJs I'm afraid, but will ask someone to come help with that side of things.

    Also if you still have the claim form can you type out what their 'particulars of claim' say - leaving out names and account numbers if any.

    You actually have fourteen days to ''acknowledge'' the claim, which gives you another fourteen to defend (just for future ref).

      Thanks amethyst acuallywithmy life being in amess they now have judgement against me . The problem is that they put ina repayment schedule over three payments. laughable ofcourse as I have no income at alll . Have writtewn to the court manager asking for he correct formfor avariationof judgement but what do i putin the form .I have no income of any sort as my contibution based jsa has stopped and i am still waiting for a descision on contibution based. This may takesome time as the beaurocrats have lost the first copy i sent them and not sent the replacement i requested so down the dole office today to try andsort it out .

        Any adverse credit history can be bad for Financial Services - CCJ is usually a stop against working in it - depends what you do tho.

          Actually and very ironically i used to work for welcome finance in the collection unit lost that job when welcome went belly up . oh andthey owe loads wll into 7 figures and they owe a lot to nat west so they collect from us to pay a bank that's owned by us. Hmmmm that way madness lies. :christmas3:

            I am working on getting a variation on the order withing the 16 days which needs to be filed at the court by 4pm on the 10th I have lodger but part of the income from each one is ised to provide two meals a day and i get £15 per student per day nd have to provide everything and I also need to ensure that they have internet as it is my main selling point . Does anyone kow what to do ?

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
