    hi, i wonder if any one can help. i have a ccj, charge order. the debt collector is now going for a order for sale. the debt collector claims to have absolute assignment but i have never received one( signed for) i have asked the courts to order the dca to show me a copy of deed of assignment the courts said they will. the dca said they are not going to show me or the court. i also have a letter of the dca saing they are not the leagal creditor so i believe they only have equitable assignment. What do you think the judge will say. the dca sued me in there own name. They lied on there statement of truth when they went for the ccj. they said that they sent proof that the debt was legally assignened to them. i did not know the court procedure at the time, hence ccj. This is my last chance to stop the order for sale, any advice please

            hi, thanks for the reply. i have lots of thing to dispute the original claim but the judge said its to late for set aside. just had a letter off the debt collector saying they are going to defend not showing the deeds on the grounds the ccj was in 2008. the form i sent to the court is for sight of the deeds, nothing to do with set aside. the debt collector just sent me a copy of there witness statement via email on sat. i am in court on tuesday. can they use this info or does it have to be sent to me 7 days before the court. nothing much on there witness of statement, just going over old rope. they did say they supplied a default notice. i never recieved one and this is confirmed with my sar request off mbna. i hope someone can help. thanks
