Welcome to Legal Beagles.

Listen really carefully to exactly what Curly Ben tells you to do. This Lowells/BC 'debt' is a nonsense, the company specialise in getting the vulnerable to pay out on statute barred debts.

The court will not defend this claim for you, just because it's bogus, they'll just issue a default judgement, but NOT if you defend it exactly as Curly tells you.

CAB are good at dealing with general consumer advice, but they won't draft a defence for you, you can and will with our help.

It's not fair that this has popped up out of the blue, you will have to deal with it though, don't be scared, don't worry....it's 100% sortable.

Feel free to PM it over to me for a read through if your unsure of anything.

It does help if you have some understanding of what we are doing, helps to calm the nerves and take the fight to them.

Also I forgot to mention, NO phone calls at all to these people concerning this matter.
Everything in writing.
IF they call you, be polite, but refuse to comment and request that they communicate ONLY in writing for the avoidance of doubt and to remove your numbers from their systems. Let THEM rant and rave as YOU now have the upper hand in this action.

They can't call as they don't have my number, I have been on the electoroll roll since i was 18 and they only managed to find me now and according to my Experian credit account info they only started searching for me on the 19/3/2010 and that was Lowell that did the search, I don't get it, but i'm very glad i stumbled on your website it's starting to make things clearer, that these people are just out for what they can get.

I will write up a draft tomoz and send it as i've taken the day off Uni to sort it.

I haven't got any new advice for you, just adding my support in your campaign against this odious little toad AKA Bryan Carter.

He'll try any dirty tricks, but if you can keep your head and do as these guys on here recommend then you'll soon have him on the ropes.

I cannot believe I am now able to write like this, last year I was petrified BC was going to have my son in jail.....not anymore. It's all fighting talk as far as he's concerned...

I wonder, does he ever have any bonafide work to do................?

Just a thought.. those POC's don't sound like they refer to a bank account:

the defendant agreed to pay monthly instalments under account number..... but has failed to do so.

sounds more like a credit card debt?
It will be interesting to see what he comes up with in response to the CPR 31.14 request.

I must Apoligise curlyben, i've had an awful lot on the last few months, wedding studying ect ect, i heard nothing back from Mr C after i sent the letter, but Monday just gone Lowells sent me a letter saying i owed this money blah blah blah WTF! and too top it off they rang my house this morning how the hell do these leeches get your number and how come all of a sudden they're trying to get money from a debt they "gave to their soliciters" who were going to take me to court and is obvious they have no intention of doing so?

What's happened with the court action. This is VERY important.

Lowell well they are easy to deal with.
Obviously when they call you make it very clear that you do not discuss financial matters over the phone and that everything must be in writing for the avoidance of doubt.

Since i sent that letter you so kindly helped me with, I've heard nothing from BC at all, it seems Lowell have taken it upon themselves to some how take the debt back and try and make me pay it, it's so frustrating, i worked out today 8 years since i left my ex and they only tried to do something about this so called debt last year and now they've started calling... complete arses!

Tomorrow you MUST call the court and check on the status of this claim.
You can't afford to have this hanging over you for whatever reason.

Thanks, i will ring northhampton court in the morning! the debt is still statute barred is it not? I found this letter on the watch dog website any good to use? I'm still bemused they actually think i owe this money they make me so mad!
Reference your letter dated ….. /or give reference number if there is one
I have no record of this debt with (name of original creditor).
Please provide me with a copy of the original statement of the account showing
exactly how the amount claimed has been calculated within 28 days of receipt of
this letter.
If I do not receive such a statement within the specified time and you continue to
contact me about this debt, I will make a formal complaint and will ask you to
investigate this through your complaints procedure, requesting a reply within 28
days. I will then contact the Financial Ombudsman Service for advice if I am still
not satisfied.

Yep call the court and we will go from there. Need to get that clarified first.

Hold fire on sending anything to Lowell for mow and certainly DO NOT send that letter at all.

Many thanks... Am i just asking if the case has been dropped by BC? I have heard nothing from The court since i contested the fact i owed the money... You think it may still be on the record i do, when Lowells ring what do i say, i know what i wanna say but thats just rude
