      I never took his bet, lol. Don't bet on dead certs, and he has insider info lol. And I work in a bookies!! Are there any late fees etc? If so, make a note of what they are, can possibly use them a later date.

            Yes, hold fire, like I said, we may be able to use them later. If you already know, then fine. If not, then don't bother just yet. It's always nice to keep a bit of ammunition saved up.....

              letter sent today, not signed, so they have to sign for delivery their end. Checked with the court and the service date is 18th July, so the lady said I have til 1st August to reply, or 31st July in real terms as that is a Saturday. If I use their online service, can I do the same as I would with the blue forms? thanks

                          Hi, I received a letter back from them today, text as below:

                          re:evans gold storecard-(ref no)

                          we refer to your recent letter in which you have made a request under the civil procedure rule 31.14

                          we are not obliged to provide information under cpr 31.14. this claim is for less than £5kand therefore the rule is not applicable.

                          we can confirm that any disclosure will be dealt with as directed by the court.the particulars of the claim should be sufficient for you to reply to the claim form.

                          we trust thjis clarifies the matter.

                            It means they are playing silly sods and as such being pains in the bum.

                            In that case I would fire off a FULL CCA request to them for the information.

                            You need to include a £1 statutory fee to cover this .

                            Don't forget to file your AoS as needed saying you are defending the full claim..

                                Pretty much yes, CPR 31.14 is for fast track claims - which are usually those over £5k - normally those under £5k are in small claims and CPR 31, nor 18 for that matter apply officially.

                                However they should still follow the preaction protocols and this includes giving you enough detail and supporting documents to understand and thus defend or admit the claim.
