  • Bit the bullet???

    Hi all, I'm new to the site so apologies if you think I've given up!! I had a Burtons card, through GE, and had missed some payments. Arranged a payment plan with them but missed the last 2 months. I was in the process of setting up a DMP and to be honest forgot to pay them. The DMP hasn't worked out (for the better I may add) as my wife has now got a job (YAY) so we earn enough to pay back all our creditors. I had conacted all but one (GE) and arranged manageable payment plans but when I contacted GE they said my account was now looked after by C L Finance (Howard Cohens). I rang them and they said they have already started legal action and court docs should be with me in a day or 2!! I was a bit shocked as I had no idea of this. They said they could spread the payments over 3 months and clear the debt and wouldn't take any other offer I made. To be honest, reading through similar threads on here, the blame is entirely mine and I don't think I would have a defence if it went to court as they prbably did send me a default notice way back when I missed the first payments but I haven't kept all the paperwork (or binned it in typical ostrich menatlity of someone in debt!!) I have agreed to pay the 3 installments as we can (just) afford it. Does anyone think this is the right thing to do or should I have took my chances???? Sorry for the rant but cheers for reading!!! G

    Have you had any notifications/letters at all from H Cohen? Threatograms? Letters in red on pukey coloured paper?

    You can write to them and offer xxx per month towards your debt. They are probably just bluffing when they say they have started legal proceedings. If they haven't, and you make a reasonable offer to pay, it would be frowned on in court if they have turned you down. If they have actually started proceedings, then you should have the paperwork in a couple of days.

    Write to them anyway, offering a reasonable payment (which you can afford, don't overstretch yourself). Remind them of the debt collection guidleines of OFT 664.

    Don't talk to them on the phone, insist that everything is kept in writing.

    There is probably other stuff you can do, someone will be along to advise shortly, I'm sure. i'm at work at the mo, just sneaked on here while the boss is out.

      Do NOT pay Cohens or CL anything.
      Have they actually written to you about this debt ??

      As and when the N1 from Cohens arrives gives us a shout as these "people" file in bulk and are normally rubbish.

      If the original creditor is going to be unreasonable and "sell" your debt without telling you then the gloves are off !!!
