    Received an Interim charging order:

    On the additional evidence to support the application:

    We believer Name: (David John peter ) and (David peter) to be one and the same person. We obtained Credit Reference Agency date which provided the name (David John Peter) alongside the Judgement debtor date of birth as detailed in section 2 of our application, this demonstrates that the defendant is linked to the property address.



    Is it possible to challenge the charging order because the name of the defendant differs from the land registry name on the property?

    How do you answer the question that will be asked whether the person named as registered proprietor is in fact the judgement debtor?

        The case background is as follows:

        Equivo - Creation Financial Service

        Having lost my job, I missed 6 payments for the judgment order and wrote Equivo to request a reduction in the monthly payment, but they never responded.
        On the Final charging order:

        A.The request must include a summary of the issue and an explanation of why the reconsideration is sought.

        Can I use the "request to reduce the monthly payment, but they never responded" as a reason to stop this charging order?
