  • BW legal threatens court

    Hi I disputed a debt owed to BW legal, originally owed to 118118 money in relation to unpaid credit card, over 2 months ago asking for proof of debt. The debt itself is just over 5 years old. BW legal were threatening court action so I asked for proof. They got back too me today with proof which looks like the original credit agreement. Although it says my name and address at the top of the agreement, there is no signature. They also sent me statements, and one of the statements says the balance was 0.00 at the very end and it was closed on my credit file too, it shows there were “payments and other credits” to the account which ended on 0.00, so do I have to pay this debt? The last statement before debt was closed says this

    That statement shows a balance of £0 as at 11 December 2020. Is that the last statement?

    If so, has the creditor given you written confirmation that nothing is owed and that no action will be taken against you?

      Yes that was the last statement. Not that I can remember, as it’s over 5 years old. But I have checked statements and the balance showing 0 is the last statement, and it was also closed in credit report too.

        I'd be tempted to make a formal complaint against the creditor, they are chasing you for money that's not owed. This has probably caused you stress dealing with it. Follow the complaints procedure on their website.

        Make your complaint in writing, attach the evidence you have to hand.
