Hi. I'm new and this my first post but this forum came highly recommended when I asked for help from friends
i received this in the post today. It's from a fine received last year. I'm not sure if I have a case for defense as I cannot prove the circumstances, but basically the driver parked in a drop off area for 10 minutes. There was a blue badge but the disabled bays were full, and two were taken by work vehicles / coned off.
This was appealed when I received the fine and it was declined. Then I received some aggressively worded letters which impacted mental health and I didn't action them, I threw them out.
Is it worth trying to put a defense out for this? It is not a paid car park, so the "loss" they made by borrowing a drop off space for 10 mins doesnt equate to the penalty fine....but i dont know if i can win that argument?
Any help gratefully received. I don't have the best MH, I'm overwhelmed and neurodiverse but I know I can't ignore this. Thank you
I tried to add attachments of the particulars but it says I'm not permitted. They are as follows:
The Defendant (D) is indebted to the Claimant (C) for a Parking Charge(s) issued to vehicle ******* at xxxxxxx 2. The PCN(s) were issued on 01/10/2023 3. The defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason:Parked In A Drop Off Point 4. In the alternative the defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4. AND THE CLAIMANT CLAIMS 1. £170 being the total of the PCN(s) and damages. 2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £.02 until judgment or sooner payment. 3. Costs and court fees
Amount claimed 177.48
Court fee 35.00
Legal representative's costs 50.00
Total amount 262.48
